REVIEW OF CORRESPONDENCE
1.
FEMA Assistance to Firefighters Grant (Supplemental
COVID-19 Grant) – Clerk Picariello noted the award of the grant.
The amount was for $2,824.76 and the JVFC contributed $141 to the
purchase of safety equipment.
2.
Burlington County Municipal Park Grant Award –
Clerk Picariello noted she received an email today that North Hanover
Township has been awarded the Burlington County Municipal Park Grant for
$75,000 and stated formal notification would be forthcoming.
3. Note of appreciation from the family of Lou DeLorenzo – Clerk Picariello read into the record correspondence received from the family of deceased Committee Member, Lou DeLorenzo.
ENGINEER’S REPORT Engineer Hirsh reported that the FY2016 Municipal Park Grant was being worked on for reimbursement. He stated the FY2018 NJDOT project is complete and he was preparing final payment and reimbursement. He noted the FY2019 NJDOT project was also complete and he was working on reimbursements. The FY2020 NJDOT project was being revised and it is anticipated to advertise for bids next week. He also stated the NJNG contractor has performed full depth paving repairs on Provinceline Road on our side. The entire roadway will be milled and paved once construction is complete. Committeeman Kocubinski noted he received a lot of feedback from the public.

RESOLUTION APPROVING 2020-2021 ALCOHOLIC BEVERAGE CONTROL
LICENSES IN THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON, STATE
OF NEW JERSEY
WHEREAS, applications
have heretofore been filed with the State of New Jersey, Division of
Alcoholic Beverage Control
to renew Alcoholic Beverage Licenses; and
WHEREAS, the Chief of Police has reviewed said
applications and recommends renewal without reservation; and
WHEREAS, the
applications appear to be in proper form, municipal fees have been paid
and are subject to review and approval by the Division of Alcoholic
Beverage Control;
NOW, THEREFORE, BE IT
RESOLVED, by the Township Committee of the Township of North
Hanover, in the County of Burlington and State of New Jersey, that the

2020-96 Resolution Accepting the 2019 Municipal Audit

ACCEPTING THE 2019 MUNICIPAL AUDIT
WHEREAS, N.J.S.A. 40:A5-4
requires the Governing Body of every local unit to have made an annual
audit of its books, accounts and financial transaction, and
WHEREAS, the Annual Report of
Audit for the year 2019 has
been filed by a Registered Municipal Accountant with the Municipal Clerk
as per the requirements of N.J.S.A. 40A:5-6, and a copy has been
received by each member of the Governing Body, and
WHEREAS, R.S.
52:27BB-34 authorizes the Local Finance Board of the State of New Jersey
to prescribe reports pertaining to the local fiscal affairs; and
WHEREAS, the Local Finance
Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the
governing body of each municipality shall, by resolution, certify to the
Local Finance Board of the State of New Jersey that all members of the
Governing Body have reviewed, as a minimum, the sections of the annual
audit entitled:
General Comments and Recommendations; and
WHEREAS, the members of the
Governing Body have personally reviewed, as a minimum, the Annual Report
of Audit, and specifically the sections of the Annual Audit entitled:
Comments and Recommendations as evidenced by the group affidavit form of
the Governing Body, and
WHEREAS, such Resolution of
Certification shall be adopted by Governing Body no later than
forty-five days after the receipt of the annual audit, pursuant to
N.J.A.C. 5:30-6.5; and, and
WHEREAS, all members of the
Governing Body have received and have familiarized themselves with, at
least, the minimum requirements of the Local
Finance Board of the State of New Jersey, as stated aforesaid
and have subscribed to the affidavit, as provided by the Local
Finance Board, and
WHEREAS, failure to comply
with the promulgation’s of the Local Finance Board of the State of New
Jersey may subject the members of the local Governing Body to the
penalty provisions of R.S. 52-27BB-52 to wit: R.S. 52:27BB-52 – “A local
officer or member of a local Governing Body who, after a date fixed for
compliance, fails or refuses to obey an order of the Director (Director
of Local Government Services), under the provisions of this Article,
shall be guilty of a misdemeanor and, upon conviction, may be fined not
more than one thousand dollars ($1,000.00) or imprisoned for not more
than one year, or both, in addition shall forfeit his office”.
NOW, THEREFORE, BE IT RESOLVED
that the Governing Body of North Hanover Township, hereby states that it
has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified
copy of this Resolution and required affidavit to said Board to show
evidence of said compliance.
2020-97 Resolution Approving Participation with the State of New Jersey Safe and Secure Communities Program Administered by the Division of Criminal Justice, Department of Law and Public Safety

A RESOLUTION APPROVING PARTICIPATION WITH THE STATE OF NEW JERSEY SAFE
AND SECURE COMMUNITIES PROGRAM ADMINISTERED BY THE DIVISION OF CRIMINAL
JUSTICE, DEPARTMENT OF LAW AND PUBLIC SAFETY
WHEREAS, the North Hanover
Township Committee wishes to apply for funding for a project under the
Safe and Secure Communities Grant Program 20-0326 for the period of May
18, 2020 through May 17, 2021; and
WHEREAS, the
Committee of North Hanover Township has reviewed the accompanying
application and has approved said request; and
WHEREAS. the project
is a joint effort between the Department of Law and Public Safety and
North Hanover Township for the purpose described in the application.
NOW, THEREFORE, BE IT RESOLVED
by Township Committee of North Hanover Township that
1.
As a matter of
public policy North Hanover Township wishes to participate to the
fullest extent possible with the Department of Law and Public Safety.
2.
The Grant is to
be in the amount of $30,000.00, to which the Township of North Hanover
shall make a match of $35,485.58 for a total project cost of $65,485.28.
3.
The Division of
Criminal Justice shall be responsible for the receipt and review of the
applications for said funds.
4.
The Township of
North Hanover is hereby authorized to accept and does accept the sub
award of the grant funds; and
5.
The Township of
North Hanover accepts the grant funds for the specific purpose described
in the Grant Application
2020-98 Resolution Appointing a Recreation Advisory Committee Member

APPOINTMENT RECREATION ADVISORY COMMITTEE MEMBER
WHEREAS, N.J.S.A. Title 40 and Title 40A provide for the Appointment of Certain Officers, Appointees, and Employees to be appointed in Township Positions to carry out the lawful duties and responsibilities of the Township; and
WHEREAS, the Recreation Advisory Committee has vacancies created by resignations of individuals or by term expirations; and
WHEREAS, it is the desire of the North Hanover Township Committee to fill the vacancies
NOW THEREFORE BE IT RESOLVED, that the following Officers,
Appointees, and Employees are hereby appointed for their respective
terms, as follows:

BE IT FURTHER RESOLVED that this Resolution shall take

Resolution Authorizing Shared Services Agreement with the Board
of Chosen Freeholders of Burlington County and North Hanover Township
for Central Communications

AUTHORIZING SHARED SERVICES AGREEMENT WITH THE BOARD OF CHOSEN
FREEHOLDERS OF BURLINGTON COUNTY AND NORTH HANOVER TOWNSHIP FOR CENTRAL
COMMUNICATIONS
WHEREAS, the Township has
requested the Burlington County, Public Safety Department, Division of
Central Communications (the “County”), assume responsibility for the
Township’s Central Communications ”911” calls; and
WHEREAS, the County has
agreed to assume such services for the Township as it has done for a
number of municipalities within the County, recognizing the cost savings
to the participating units; and
WHEREAS, the County now seeks
to enter into a Shared Services Agreement with the participating
municipalities to memorialize the mutual obligations of the parties with
respect to the Central Communications System; and
WHEREAS, the proposed
agreement would provide for this shared service for the period from July
31, 2020 through July 31, 2025; and
WHEREAS, the Township
Committee upon recommendation of the Police Department desire to enter
into the Shared Service Agreement in recognition of the cost savings and
the benefits of a county-wide emergency communications system.
NOW, THEREFORE, BE IT RESOLVED
by the Township Committee of North Hanover Township, County of
Burlington, State of New Jersey as follows:
1.
That the
Township is hereby authorized to enter into the Shared Service Agreement
with the Burlington County Board of Chosen Freeholders for participation
in the County Central Communications System.
2.
That the Mayor
and Township Clerk is hereby authorized and directed to execute the
Shared Services Agreement.
3. That the Township Clerk is hereby authorized and directed to forward a certified copy of this Resolution to the Burlington County Department of Safety Services.
DISCUSSION
·
Various Drainage Issues – Engineer Hirsh
reviewed the various issues. Attorney Roselli gave his legal opinions of
current zoning, land use ordinance and Health public nuisances.
After discussion, there was a consensus to proceed as follows: 7
Patty Drive the site now appears to stabilizing with grass growth; will
monitor. 6 Larry Lane – the
Zoning/Construction Official have enforcement capability and the Mayor
will follow up with the Department.
282 Provinceline Road – will have public works contract clear
brush to see if a drain exists and revisit.
Cromwell Drive – will need to send a push cam down.
Edwards Drive – the inlet will need reconstructed.
The Mayor will seek quotes.
Sykesville Road at Crowshaw – Engineer will shoot grades and will
revisit.
Crosswicks-Ellisdale Road Intersection – Engineer will check the right
of way and determine if it falls under the Upper Freehold agreement.
It was also discussed updating fees associated with the zoning
ordinance. Attorney noted
he would ensure a general penalty section in the new code.

Possible reopening of Municipal Building and/or
Public Meetings- The consensus was to move forward with a hybrid
meeting. Social distancing
guidelines would be followed and Attorney Roselli would draft the
advertisement. Attorney
Roselli also noted the room must be wiped down after any meeting.
TOWNSHIP COMMITTEE “COMMENTS” Committeeman Kocubinski stated the census bulletin board truck came to Spartan Village. He expressed the concern regarding the base residents and suggested contacting the Congressman to assist with an accurate count. He inquired about the soccer program. Deputy Mayor Doyle noted due to liabilities and lack of participation it was decided to cancel the season. He stated he would have reported at the August 6th meeting but it was canceled due to power outage.
Committeeman O’Donnell noted his displeasure with JCPL during the recent storm. He noted it was unfortunate and complaints seem to go unheard. He thanked the JVFC for opening a comfort station for the residents.
Committeeman Forsyth state the annual clean-up day will be held October 10th. Deputy Mayor Doyle noted JCPL performance, during the storm, was unacceptable. He noted he was considering filing a complaint with the BPU in conjunction with neighboring towns. He also noted his desire to draft a letter expressing the displeasure to JCPL. All present were in favor. He stated residents lost their food. He also stated that using the JVFC as a water/ice distribution center was discussed last storm and was not addressed this storm. He also noted movie night was being planned for September 18th and Committee volunteers would be needed to assist attendees to their socially distant seating. The attendees would have to register and sign a COVID – 19 waivers. He thanked everyone for their sentiments during the passing of his father-in-law. He expressed appreciation for the JV EMS.
Mayor DeBaecke also noted JCPL performance was unacceptable. He gave an overview of the work Deputy Mayor Doyle and he did during the week of the storm. He noted a lot of residents had contacted him and he reiterated he was continually working the power outage. He stated it appears the middle management at JCPL was lacking and he would continue to address.

Mr. Wayne Voorhees – Mr. Voorhees thanked the Mayor for the appointment to the JLUB. He was looking forward to serving the Town in this capacity.

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and
WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.
NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Police Personnel Matter, Contract Matters, Litigation and Personnel matters. BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
